I / Purpose of the privacy policy

This privacy policy is established to inform users of the 'Linktopharma' Platform, owned and operated by the company 'one stop pharma connect', of the following terms and conditions:

- The personal data collected by the Platform

- The purposes for which this data is processed

- Access to such data

- The rights of data subjects (Platform users)

- Policy on the use of cookies

This privacy policy is an integral part of the general terms and conditions of the 'Linktopharma' Platform.

Definitions

Personal data: any information, regardless of its medium, concerning an identified or identifiable person, hereinafter referred to as the 'data subject', directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, genetic, biometric, mental, economic, cultural or social identity;

Data controller : Natural or legal person, public or private, or any other entity which, alone or jointly with others, determines the purposes and means of data processing.

Sub-processor: any natural or legal person, public or private, or any other entity that processes personal data on behalf of the controller.  

Processing of Personal Data: hereinafter referred to as 'processing': any operation or set of operations carried out by automated or non-automated means or processes and applied to personal data, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, communication by transmission, dissemination or other interconnection, as well as blocking, encryption, form of making available, alignment or interconnection, as well as blocking, encryption, erasure or destruction .

Data subject(s): any informed expression of will by which the data subject or his/her legal representative agrees to his/her personal data being processed manually or electronically.

National Authority: national authority for the protection of personal data.

Sensitive data: personal data revealing the racial or ethnic origin, political opinions, religious or philosophical beliefs or trade-union membership of the person concerned, or relating to his or her health, including genetic data.

II / Applicable laws

The entry into force of Law No. 18-07 of June 10, 2018 on the protection of individuals in the processing of personal data to introduced legal requirements for the processing of its data. As a result, Linktopharma will process Personal Data in accordance with the following principles:

• Lawfulness - Personal Data is collected and processed once the Data Subject's consent has been obtained or when the Processing is legitimate or meets a legal obligation;
• Fairness - Processing of Personal Data shall take into account the particular circumstances and context in which the data is processed;
• Specific purposes - Personal Data must be processed for specific, explicit and legitimate purposes, and may not be further processed in a way incompatible with those purposes;
• Minimization of Personal Data - Personal Data collected shall be adequate, relevant and not excessive in relation to the purposes for which they are collected or processed;
• Accuracy and updating of Personal Data - Personal Data must be accurate, complete and kept up to date where necessary.
• Limitation of retention - Personal Data must be kept in a form that allows identification of the Data Subjects for no longer than is necessary for the purposes for which it was collected or processed.

III / Consent

By using the 'Linktopharma' Platform, users consent to :

- All the conditions included in the present privacy policy;

- The collection, use and storage of the personal data listed in this privacy policy and for the purposes set out in the GCU.

IV / Categories of Personal Data collected

When browsing the 'Linktopharma' Platform, various personal data about users are collected.

The following data is collected automatically:

1-     PERSONAL DATA RELATING TO VISITORS/CUSTOMERS

• ID or passport expiry date
• Copy of ID required for corporate customers and validated profile required for indvidu customers

Other business or financial data may be collected as part of the platform's activities, such as

• Company name
• Company registration number 
• Company email address
• Company telephone number
• Company postal address/ city/ country
• Social networks
• Subscription, payment and billing data.

Consequences of refusal to provide mandatory data :

- Impossibility of validating the account by the admin of the 'Linktopharma' platform. 

- Inability to request quotes or contact suppliers.

2- PERSONAL DATA RELATING TO SUPPLIERS

Mandatory data collected :

- For the legal representative :

•  Last name
• First name
• Email address
• Password
• Telephone number
• Postal address/ city/ COUNTRY
• Date of birth
• ID or passport number
• ID or passport expiry date
• Copy of ID or passport

Other business or financial data may be collected as part of the platform's activities, such as :

• Company name
• Company registration number 
• Company email address
• Company telephone number
• Company postal address/ city/ country
• Social networks
• Subscription, payment and billing data.

Consequences of refusing to provide mandatory data:

Any supplier who does not wish to provide the necessary information will not be able to appear on the platform or benefit from its various Services.

No additional data is collected without the user's prior consent.

V / Data processing

Personal data collected on the 'Linktopharma' Platform are collected and processed only for the purposes specified in this Privacy Policy and/or in the relevant pages of the 'Linktopharma' Platform or in the GCU. The personal data we collect will not be used for any other purpose.

VI / Sub-processing of personal data :

The company 'One Stop Pharma Connect' does not subcontract the processing of personal data as part of its activities, however, personal data may be communicated to third parties in the following cases:

Third parties: Subcontractors may include :

-         Hosting companies,

-         IT, marketing, telephony service providers, etc.

-         authorities if necessary

'One stop pharma connect' takes all measures to require these recipients to comply with applicable regulations and, where applicable, that subcontractors are based on an adequate level of protection or sufficient guarantees. The subcontractors of 'One stop pharma connect' are authorized to process Personal Data only on instructions from the latter.

Furthermore, the Personal Data collected may be shared:

- if 'One Stop Pharma Connect' is required to do so by law

- If the information is required for legal proceedings

- To protect the legal rights of 'One Stop Pharma Connect'.

Except as provided in this policy, personal information will not be disclosed or shared with third parties under any circumstances.

VII / Storage and protection of personal data

Personal data is stored exclusively in Algeria at the hosting company AYRADE.

The platform does not transfer data abroad

One Stop Pharma Connect' does not store personal data for longer than is necessary to achieve the purposes for which it is collected.

Retention period / Archiving: personal data collected in the context of the activities of the company 'One Stop Pharma Connect' will be kept for a period of 2 years from the deletion of the account, for the purposes of customer service, legal obligations, statistics and after-sales services.

Technical and organizational data protection measures :

In order to protect this data, we implement the following measures:

Data encryption: All personal data is stored and transmitted in encrypted form, using secure protocols such as SSL/TLS.

Restricted access: Access to personal data is strictly limited to employees and subcontractors who need it to carry out their work. All authorized users are subject to strict confidentiality obligations.
